(20 Jan) U.S. Attorney General Alberto Gonzales went to court last week to
force Google to comply with a subpoena for "a list all requests entered into
Google's search engine during an unspecified single week.... In addition, it
seeks 1 million randomly selected Web addresses from various Google
databases."

The government had narrowed its original request for all URLs that a
searcher could locate via Google as of 31 July 2005. It had also requested a
list of all queries entered from 1 June to 31 July 2005.

The stated purpose for the request is to defend the constitutionality of the
Child Online Protection Act (COPA). "The production of a set of queries
entered into Google's search engine would assist the Government in its
efforts to understand the behavior of current web users, to estimate how
often web users encounter harmful-to-minors material in the course of their
searches, and to measure the effectiveness of filtering software in
screening that material."

Perhaps more disturbing than the request itself is that we learned about it
because Google refused to comply. Yahoo and Microsoft admitted to complying
with similar requests. "America Online said it didn't fully comply with the
subpoena but did provide a list of search requests already publicly
available from other sources." All the search engines claim their compliance
did not reveal personal information.

(20 Jan) The Federal Communications Commission issued two citations last
week to brokers of cell phone records. The brokers, Locatecell.com and
DataFind.org, failed "to comply with an order issued by the Federal
Communications Commission requiring the production of documents and
information."

libraries, Kevin Dames discusses the first sale doctrine. "Generally, 'first
sale' allows anyone who rightfully and legal owns a copy of a protected work
to resell, rent, or lend that copy to another person or entity.... Over the
last decade, however, several changes have occurred that threaten first
sale's future viability."

(19 Jan) The National Consumers League last week released its report on
telemarketing and Internet-related scams. It shows an increase in both the
number of reported scams and the amount of money lost.

"[T]he average loss to telemarketing fraud rose from $1,974 in 2004 to
$2,892 in 2005, and Internet fraud losses more than doubled, from an average
of $895 in 2004 to $1,917. The number of scams reported rose by 39 percent
for telemarketing fraud and 12 percent for Internet fraud."

(23 Jan) The Government Accountability Office reports on its study of 4
industries that share customer Social Security numbers with contractors. The
industries -- banking, securities, telecommunication and tax preparation --
share SSNs with contractors for limited purposes. But each has different
levels of regulation and oversight.

(23 Jan) The article provides a brief overview of a new "deep Web" search
service called CloserLook. Amongst other things, the service claims to help
law firms locate people. It purports to retrieve information you cannot find
with a public Web search engine, such as Google or Yahoo.

I attempted to test the skip-tracing tool, Gotcha, which you will find
here[1]. But I stopped when I was asked to transmit a credit number over an
unsecured connection.

I've requested more information from the site and will publish a follow-up
if I am able to test the service. As of this writing, I have received no
response.
