So they’re doing pretty well on that count. Their pictures have captions, too, but proper citations? Links to more information? No and no. Sound like trouble? Yes and yes.</p><h2 id="orphanworks">Orphan Works</h2><p>According to the <a href="http://web.law.duke.edu/cspd/orphanworks.html" target="_blank" data-mce-href="http://web.law.duke.edu/cspd/orphanworks.html">Duke University Center for the Study of the Public Domain</a>, orphan works are “still presumably under copyright (only works published before 1923 are conclusively in the public domain), but the copyright owner cannot be found.” A surprisingly large number of works fit this description.</p><p>There’s lots of interest in photographic collections, which you can see in Tumblr blogs from <a href="http://natgeofound.tumblr.com" target="_blank" data-mce-href="http://natgeofound.tumblr.com">National Geographic</a>, <a href="http://houghtonlib.tumblr.com" target="_blank" data-mce-href="http://houghtonlib.tumblr.com">Houghton Library</a> or the <a href="http://digitalpubliclibraryofamerica.tumblr.com" target="_blank" data-mce-href="http://digitalpubliclibraryofamerica.tumblr.com">DPLA</a>. These sites are careful to give attribution for these images, which is copyright-correct, but it also conveys accurate context to viewers.</p><p>When that context isn’t known, a photograph isn’t just an image without a label. It’s a potential lawsuit. That can leave libraries with collections they can’t share online out of caution, leaving those collections undiscovered by potential audiences. Missing context also leaves plenty of space for mistakes, misinformation and outright untruth. <a href="http://sarahwerner.net/blog/index.php/2014/01/its-history-not-a-viral-feed/" target="_blank" data-mce-href="http://sarahwerner.net/blog/index.php/2014/01/its-history-not-a-viral-feed/">If you’re a historian or simply interested in history, that’s troubling</a>.</p><p>The U.S. Copyright Office is asking for public comments to help them approach future copyright legislation.
