IMHO the "personal gain" clause of most AUPs is a hold over from the
days when teaching assistants or departmental secretaries would log
their terminals into the networked version of WordPerfect and type term
papers.
Today, if you give me access to web-based email and a browser I can run
a pay to read email business, manage my EBay store, maintain my web
page, and with a little effort use safe lists to send what is called
opt-in emails aka spam. None of these things, if I do it within my two
one-hour sessions, is a violation of any policy we have here.
The only way I can see to control this would be to take away my browser,
or filter out my ability to read email.
Long-term, IMHO, I think libraries will be re-evaluating why the
computers are actually there for the public i.e. access to the catalog
and reference products, but short-term I don't think there is anything
you can do.
But, you may try to see if the real problem may be that the disgruntled
patron could not get access to a computer because some other patron was
exceeding her time limits.

   Bluffton Public Library just received a letter from "a disgruntled"
tax payer complaining we have some people using our public terminals
"for personal gain".  It is in the OPLIN policy that "commercial
activity; including but not limited to operating a business for personal
gain" is prohibited on OPLIN network.
   How do you know what patrons are doing on the computer?  Should you
know, as  long as you aren't seeing something obvious like naked people
on the screen?
   I don't know how our letter writer knows people are using terminals
"for personal gain".  While we have regular users, I don't ask what they
are doing or why.  One man last summer was using a terminal about an
hour a day when his small business terminal was in the shop.  I
considered that a legitimate use. Another user wrote a book, which he
has published.  According to OPLIN policy, are those legitimate uses?
   Has anyone else run into this question at their library?  Any
suggestions for handling the issue, should the patron pursue it?
